Terms of Service

1. Acceptance and Eligibility
ELIMFILTERS is a brand and digital platform operated by Kleo Technology LLC, a Texas limited liability company. By accessing or using elimfilters.com, Part Search, the Knowledge System, distributor tools, APIs, bots, AI-assisted services, or other ELIMFILTERS digital platforms, you agree to these Terms of Service and the policies incorporated by reference. If you use the services for a company or other organization, you represent that you are authorized to bind that organization. You must be legally capable of entering a binding agreement and may not use the services where prohibited by law.
2. Platform Purpose
The services support industrial contamination control, product research, technical education, cross-reference lookup, distributor operations, and asset-protection decision support. Content and recommendations are informational and do not replace application-specific review by qualified engineering, maintenance, safety, warranty, or procurement personnel.
3. Accounts and Access
You must provide accurate information, protect credentials, use only authorized accounts, and promptly report suspected compromise. Account sharing, resale of access, credential transfer, or access outside an authorized distributor or customer organization is prohibited. ELIMFILTERS may impose reasonable usage, security, geographic, feature, or rate limits.
4. Acceptable Use
Use of the services is subject to the Acceptable Use Policy. You may not scrape, crawl, harvest, reverse engineer, attack, disrupt, bypass safeguards, extract data in bulk, train competing models, reconstruct proprietary datasets, introduce malicious content, or use the services to violate law or third-party rights.
5. Intellectual Property
The services, software, databases, technical documentation, product data, system architectures, images, text, and proprietary technology names, including MACROCORE™, MICROKAPPA™, DRYCORE™, INTEKCORE™, SYNTRAX™, NANOFORCE™, HYDROCORE™, HYDROCORE/SERIES™, THERMACORE™, MARINECLEAN™, and DURATECH™, are owned by Kleo Technology LLC, ELIMFILTERS, or their licensors. Except for the limited right to use the services under these Terms, no rights are transferred. Unauthorized reproduction, redistribution, commercial exploitation, or removal of notices is prohibited.
6. User Submissions
You retain ownership of lawful content you submit. You grant ELIMFILTERS a limited, worldwide, non-exclusive license to host, process, reproduce, analyze, and transmit submitted content as necessary to operate, secure, support, and improve the requested services. You represent that you have authority to submit the content and that it does not violate confidentiality, privacy, export-control, intellectual-property, or other legal obligations.
7. Cross-Reference and OEM Data
Cross-reference relationships identify potentially compatible products and are not warranties of identical construction, media, efficiency, capacity, service life, certification, or performance. OEM names and part numbers belong to their respective owners and are used solely for identification. Users must validate dimensions, specifications, equipment configuration, operating conditions, warranty requirements, and current OEM documentation before purchase or installation.
8. AI-Assisted Features
AI outputs may contain errors, omissions, outdated information, or incomplete assumptions and may not be reviewed by a human. Outputs are advisory only. Do not submit unnecessary personal data, regulated data, third-party confidential information, or trade secrets. ELIMFILTERS may process and retain interactions for service delivery, safety, security, audit, support, and improvement as described in the Privacy Policy and AI Use Policy.
9. Orders, Quotes, Availability, and Pricing
Unless expressly stated in a separate signed agreement, platform listings, availability indicators, lead times, and quotations are informational and may change. An order is not accepted until confirmed by ELIMFILTERS or an authorized seller. Taxes, shipping, duties, minimum quantities, payment terms, warranties, returns, territories, and product-specific conditions may be governed by separate commercial documents.
10. Distributor Obligations
Distributors and authorized partners must protect confidential business data, credentials, prices, leads, customer information, territory information, and platform materials. Access may not be shared, sublicensed, resold, or used outside the authorized relationship. Additional obligations are governed by the applicable Distributor Agreement, confidentiality agreement, data-processing terms, or other signed contract.
11. Suspension and Termination
ELIMFILTERS may suspend, restrict, or terminate access when reasonably necessary for security, nonpayment, legal compliance, platform integrity, investigation of misuse, protection of intellectual property, or material violation of these Terms. Where practicable, notice and an opportunity to cure may be provided. Provisions concerning ownership, confidentiality, disclaimers, liability, indemnification, disputes, and accrued obligations survive termination.
12. Disclaimers
THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. ELIMFILTERS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, AND ERROR-FREE OPERATION. ELIMFILTERS DOES NOT WARRANT THAT A CROSS REFERENCE, AI OUTPUT, SEARCH RESULT, OR TECHNICAL STATEMENT IS SUITABLE FOR A PARTICULAR EQUIPMENT CONFIGURATION OR OPERATING CONDITION.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELIMFILTERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, PRODUCTION, OR USE; EQUIPMENT DAMAGE; DOWNTIME; OR COSTS OF SUBSTITUTE GOODS OR SERVICES ARISING FROM USE OF OR RELIANCE ON THE SERVICES. ELIMFILTERS'S AGGREGATE LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT PAID BY THE CLAIMANT FOR THE RELEVANT DIGITAL SERVICE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, EXCEPT WHERE LAW PROHIBITS THAT LIMITATION.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Kleo Technology LLC, ELIMFILTERS, and their personnel from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use, violation of these Terms, misuse of technical information, infringement of third-party rights, unauthorized submissions, or use of the services on behalf of an organization without authority.
15. Privacy and Electronic Communications
Data processing is governed by the Privacy Policy and Cookie Policy. By providing contact information, you authorize service, security, transaction, support, and account communications. Marketing communications will be handled according to applicable law and available opt-out controls.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Before filing a claim, the parties will attempt in good faith to resolve the dispute through written notice describing the claim and requested relief. Unless a separate signed agreement provides otherwise, exclusive venue for proceedings concerning these Terms will lie in the state or federal courts serving Collin County, Texas, and each party consents to personal jurisdiction there. Nothing prevents either party from seeking temporary or injunctive relief to protect security, confidential information, or intellectual-property rights.
17. General Terms
Neither party is liable for delay caused by events beyond reasonable control. If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; ELIMFILTERS may assign them in connection with a reorganization, financing, merger, sale, or transfer of the relevant business. These Terms and incorporated policies constitute the agreement governing general platform use unless superseded by a signed agreement.
18. Changes and Contact
Kleo Technology LLC may update these Terms to reflect changes in ELIMFILTERS services, law, security, or business operations. Material changes will be identified by the effective date and, where appropriate, an additional notice. Questions or legal notices may be sent to info@elimfilters.com.
